high court jo dusri party chali gyi hai wo kis liye gyi hai....appeal mai gyi.....aapka jo talaak hua tha kya wo talaak ex parte hua tha kya ya dono partiyo ne contest kiya tha poora case ya fir settlement hui thi....poora case ki detail btani hogi tabhi btaya jayega.

Hi, Yes you can if the appeal filed is beyond the statutory time limit. However, If it is filed within the specific statutory time duration and it's pending before the High Court you have to wait for the final order of the court.

The decree of divorce has been passed by the lower court, but since the opposite party has filed an appeal before the High Court, the decree is not yet final. Until the High Court either upholds the divorce decree or dismisses the appeal, you cannot legally remarry. If you marry during the pendency of the appeal, it may amount to bigamy under Section 494 IPC. Therefore, it is advisable to wait until the High Court’s final decision before entering into a second marriage.

If there is no stay on the order of the lower court You can remarry but if there is stay you can't remarry Whats the exact status quo in the High court also appraise about other pending cases if any I hope your doubt is curated

If you contract a second marriage before the High Court decides the appeal, it may amount to bigamy under Section 494 of the Indian Penal Code. Therefore, it is advisable to wait until the High Court either dismisses the appeal or confirms the decree of divorce before entering into a second marriage.
