Safe Loan and property relinquishment for mutual divorce

25-Nov-2025 (In Divorce Law)
Hi, we are in talks with opposite party for divorce with mutual consent but not confident about the conditions in MOU, specially regarding relinquishment of our share before second motion. How can we secure the relinquishment if other arty backs out which i have very strong feeling. I tried checking in registrar office if conditional deed can be done but they said, it can't be conditional. Please guide

In a mutual-consent divorce, it is important that no party is compelled to transfer property before the second motion, since either side can legally withdraw consent until the decree is granted. Because a conditional relinquishment deed cannot be registered, the safer way to protect yourself is to ensure that the MOU clearly states that the relinquishment of the share will take place only after the second motion is completed, and to simultaneously execute an irrevocable agreement to relinquish signed and notarized which, although not registrable as a conditional deed, still provides strong contractual security. You can also keep the relevant property documents or draft deeds in escrow with a neutral advocate so that neither party can misuse them, and request the court to officially record the MOU during the first motion, so that any withdrawal without valid reason is viewed unfavorably by the court. These measures cannot eliminate all risk, but they offer the strongest possible protection until the divorce is finalized.

In a Mutual Consent Divorce (MCD), neither party should surrender or transfer property rights before the Second Motion because the law allows either spouse to withdraw consent at any time before the final decree. If you relinquish your share early and the other party backs out, you will have no legal protection. A conditional relinquishment deed also cannot be legally registered, so it does not safeguard your interests. The safest and legally sound method is to execute a detailed Memorandum of Understanding (MOU), clearly recording all settlement terms, including that any property transfer will take place only after the Second Motion is successfully completed. This MOU should be signed and notarized by both parties. To secure compliance, you may also take post-dated cheques, bank guarantees, or any mutually agreed security instrument from the opposite party. Additionally, ensure that the terms of settlement mentioned in the MOU are also incorporated into the joint MCD petition, so the court records them officially. Until the Second Motion is passed and the decree is granted, avoid signing or registering any irreversible relinquishment deed or property-related document. This approach protects your rights while allowing the mutual divorce process to proceed smoothly.

Hello, both of you pl appoint third party whom you both trust and hand him over bank cheques equal to relinquishment. After that go for divorce unconditional. Now, in case any party backs out, file criminal case of cheque bounce. In this situation, no party shall back out.
