Hi Sai, yes, if you already have a restraining order, she can be legally stopped from entering the house. But if it’s her matrimonial home, she may still claim residence rights. To protect your parents, it’s best to get a clear court order mentioning your house and occupants.

A wife has a legal right to reside in her matrimonial home (shared household) under Section 17 of the Domestic Violence Act, 2005, unless a competent court specifically restrains her. However, if the property exclusively belongs to you or your parents and is not jointly owned or rented by you and your wife, she cannot forcibly enter or claim residence there without a court order. You or your parents may file a civil injunction or restraining order before the jurisdictional court to prevent her unlawful entry or interference, especially since you are abroad. Keep property documents ready to prove ownership. The court can protect your parents’ peaceful possession until the dispute is adjudicated.
