If the respondent fails to appear before the court either physically or through VC then the judge has got the power to issue ex-parte orders against the erring party. For more legal assistance I am just a call away.

The judge may record the absence on record and, if satisfied that due notice was served, may close the respondent’s right to further cross-examination or evidence. Thereafter, the matter can proceed for final arguments and an ex parte decree may be passed based on the petitioner’s evidence. However, in some cases, the judge may grant one final opportunity if the absence is justified through valid reason or medical ground, but repeated defaults without explanation usually lead to ex parte proceedings rather than adjournment or imposition of fine.

If the respondent is repeatedly absent without any valid reason, the court can proceed ex parte and continue the divorce case based on the petitioner’s evidence. The judge may also impose costs for non-appearance, but generally the court gives one last opportunity before passing ex parte orders. Since the matter is already at the stage of cross-examination, the court is unlikely to delay it further. For a precise opinion based on full case details, please contact me directly.
