Please advise the legal procedure for divorce in mutual consent
File a Joint Petition (First Motion) in Family Court
2️⃣ Court records statements of both husband and wife
3️⃣ A 6-month cooling-off period (can be waived by the court in some cases)
4️⃣ File the Second Motion after the cooling period
5️⃣ Court passes the Final Divorce Decree
Time required: Usually 6 months to 1 year, depending on the case.
For mutual consent divorce, both spouses must jointly file a petition before the Family Court stating they have lived separately for at least one year and have mutually agreed to dissolve the marriage. After the First Motion statements, a cooling-off period (usually six months) applies. Thereafter, Second Motion is filed and upon confirmation, decree is granted.
For divorce by mutual consent, both the parties shall be agreeable to the terms and conditions which can be laid down there in. Once a petition for divorce is filed counselling is done on the first occasion. After failure of counselling, the matter goes before Court. After a period of six months, divorce is granted.
