Dear Client, 1.The relationship described—your mother’s elder sister’s husband’s brother’s daughter—is not within the degrees of prohibited relationship and not a sapinda relationship under Sections 3(f), 3(g), and 5(iv) & 5(v) of the HMA. Therefore, there is no legal prohibition under Hindu law. Family objection is social/customary, not legal. 2.Consult an advocate to discuss your case in brief. 3. You may schedule an appointment regarding your case by phone or email at your convenience. Thanks & regards, Priyanka Advocate Coimbatore

The proposed marriage does not appear to fall within the degrees of prohibited relationship or the definition of a sapinda relationship under the Hindu Marriage Act, 1955. Based on a strict interpretation of the HMA, 1955, the relationship as stated does not appear to be prohibited under Section 5(iv) or 5(v), as the woman is not a blood relative (agnate or cognate) of the man. The family's opposition is likely based on non-legal social custom or the concept of gotra which the HMA now largely overrides.
