Regarding compromise deed between me and my wife
08-Sep-2023 (In Divorce Law)
I am a 41 years old man married since 17 years. I have serious issue with my wife as she doesn't stay continuously at my home. Till date she had left my home total 4 times. 3 times with my daughter and 1 time alone. She also tried to escape from here several times. I'd tried my best to solve the case between 2 families with the help of our society. This time she is at her home since last 17 months with my younger daughter and she wants to return to my home. Hence, we decide to do compromise with her with compromise deed. My question is, 1. Will this compromise deed, which may some conditions, can save me in future, if she file any false case against us? 2. What I can do if she break some conditions in future?
If your wife is not interested to stay with you then take a concrete step and decide that whether you both want one another's company or not. If yes then start the life afresh. Because matrimonial life is based upon faith and trust. No deed is required for that.
In legal point of view, if in future your wife files any false case against you then that deed may help you in some extent.

First and foremost, what is it that you want?
From the looks of it,it seems you want to stay with your wife and not leave her.
1) You can file an application before the Hon'ble Family Court for restitution of conjugal rights. This will direct her to stay with you and not abandon you.
2) There is no compromise deed, however there can be something known as consent terms which you can mutually decide and notarize. In a way, it can save you from a false allegation which she may raise against you in future, however that entirely depends on the consent terms and even otherwise it may not entirely save you. It wholly depends on facts and circumstances and the purpose of consent terms. It has to be specific in nature. It can't be vague in conditions.
I am honestly not getting the dots here. Why would she file any false case against you? Would need more details to provide you with a satisfactory answer.
Feel free to approach me for legal consultation.
