From the facts stated, there is nothing legally improper in signing an MoU first, provided it comprehensively records all settlement terms. However, do not rely on oral assurances. The MoU should specifically mention the complete list of jewellery/stridhan, the place and mode of delivery, the timeline, and the stage at which mutual consent divorce will be filed. If the articles are in a locker, insist on preparing an inventory and receiving the jewellery in your presence against a written acknowledgment. It is advisable to exchange the jewellery and complete the settlement simultaneously with the first or second motion, as agreed in the MoU. Have the draft MoU vetted by your advocate before signing to safeguard your interests.

Dear Client, 1. You are not bound to sign an MoU before receiving your streedhan (jewellery and ornaments). Insist on simultaneous return of your belongings or secure them through a detailed, enforceable settlement before filing a mutual consent divorce. Seek independent legal advice before signing any document. 2. Consult an advocate to discuss your case in brief. 3. You may schedule an appointment regarding your case by phone or email at your convenience. Thanks & regards, Priyanka Advocate Coimbatore
