Query Regarding Contested Divorce Due to Irreconcilable Differences.

23-Jun-2026 (In Divorce Law)
I would like to know whether I can file a contested divorce. Due to serious differences of opinion and ongoing conflicts, I am unable to continue living with my husband. He does not respect my family and does not consider my feelings regarding important decisions. These issues have caused me significant mental stress, and I feel that the marriage has broken.

Yes, a contested divorce can be filed if there are valid legal grounds recognized under the applicable personal law. Mere differences of opinion alone may not always be sufficient; however, persistent conduct causing mental cruelty, lack of respect, humiliation, neglect of emotional well-being, or behaviour making it impossible to continue the marital relationship may constitute grounds for divorce. To assess the strength of your case, details such as the duration of marriage, nature of incidents, any attempts at reconciliation, periods of separation, and available evidence would be relevant. Depending on the facts, you may also be entitled to seek maintenance, residence rights, custody of children (if any), and other appropriate reliefs.

Dear Madam, Based on the information provided, you may file a contested divorce petition, provided there are legally sustainable grounds under the applicable personal law. The facts stated by you, particularly regarding ongoing conflicts, lack of respect, and the mental stress caused to you, may be relevant in assessing whether a case for mental cruelty can be made out. However, a detailed consultation is necessary to evaluate the complete facts and supporting evidence before advising on the merits of your case.
