QUERIES regarding Maintenance and conjugal rights

I got married as per hindu law. My query is I have Already filed for sec125 in Haryana wanted to ask what happens if my husband don't turn up on the date that is given to him of 25th August. Secondly I want to ask what is the basis for deciding the interim maintenance? & how long will it take for me to get permanent maintenance ever month? What if he don't pay me interim maintenance and files for sec 13 contested divorce because I don't want to divorce him. Will he be still liable to pay me alimony or maintenance? Or will his plea for divorce under sec 13 will be accepted.Thanks in anticipation.

Interim maintenance is a small amount depending on the capacity of the husband and your living standards. Plus it also depends on your educational qualification and working capacity. If you can work and earn on your own then court will decide the least amount of maintenance. If he does not turn up on the date given he will have to be again summoned or ex parte interim maintenance will be passed and you will have to file an execution case. How much time it will take cannot be predetermined depending on the burden upon the Court. And even if he filed section 13 he will be liable to pay maintenance and if his divorce petition is accepted it has to go through the entire process of law before a judgment is passed in it.
