Based on the facts stated by you, there is generally no legal requirement to dispose of or transfer your property before issuing a notice to your wife. If the property was purchased by your father and registered jointly in your and your brother's names prior to marriage, the nature of ownership and source of funds will be relevant considerations. However, before taking any step regarding the property or matrimonial proceedings, it is advisable to consult an experienced Family Court Advocate and have all title documents examined to avoid any future legal complications.

No, there is no legal requirement that you must dispose of or transfer your property before issuing a divorce notice to your wife. From the facts stated by you, the property was purchased prior to marriage and stands registered in the joint names of you and your brother. Prima facie, such property would not automatically become your wife's ownership merely by virtue of marriage. However, if matrimonial proceedings are initiated, issues relating to maintenance, residence rights, or financial capacity may still be considered by the court depending upon the facts of the case. Therefore, do not undertake any hurried transfer, sale or disposal of assets solely with the intention of avoiding future claims. First obtain proper legal advice based on the title documents and proposed matrimonial proceedings, and then take an informed decision.
