Procedure for filing mubarat petition in family court

 Me and my wife has decided to get divorce by mutual consent (mubarat) through court.i just want to know d procedure. Whether it's OS or OP.is there any citation available.

Hi,

Your question is not clear. If there is any Family court in your city you can file the same seeking divorce. For which you need to file OP meaning Original Petition. If there is no family court then you will have to file by way of Suit for seeking divorce. OP or OS is not the issue here.

As per the Muslim law there's no mutual consent divorce.So you can send a triple talaq notice to your wife.then you will have to file a suit for declarations of the talaq . during the course of the case ask your wife to give no objection to the triple talaq.
