Procedure for dissolution of marriage if husband has absconded.

My sister's husband is absconding from 2 years and already we have a running case of DVC in family court. Now I want to file dissolution of marriage (for khula) so that my sister can get divorce as early as possible. please suggest me the procedure and how much time will take to get degree

Since our sister's husband is absconding for 2 years, get an ex-parte order from the court in DVC case.
For a Valid Khula, you need to issue notices to the husband by issuing notices to his last known residential address and after lapse of notice period, your sister can terminate the marriage in presence of two witnesses.

For Khula, your sister's husband's consent is necessary and this may not be possible as you say that your sister's husband is absconding for 2 years so he may not come and sign on the Khula deed. Your sister may file for divorce in family court on the ground that her husband has neglected or has failed to provide for her maintenance for a period of two years. you can file a petition before the family court for dissolution of marriage for khula. As such it takes about 3-4 months if he is absconding, if he comes to contest the matter it will take considerable time.
