Do not agree to back-dated separation as it may amount to misrepresentation. You can approach the court mediation centre to record genuine terms. Mutual consent divorce requires one year actual separation and free consent of both parties.

fake separation date allowed? No. Providing a false date amounts to: False affidavit / false statement before court Possible perjury (Section 191 IPC) Ground to set aside the divorce decree later Courts rely on sworn affidavits, not just verbal statements. Practical reality (what actually happens) Courts usually do not investigate deeply unless: One party later challenges the decree There is a dispute regarding maintenance, property, remarriage, or immigration However, if challenged, a fake date can invalidate the divorce

Your concern is genuine. Mentioning a back-dated separation is not legally advisable and may create complications later. It is always safer to state the actual date of separation. Your idea of approaching the mediation centre before filing for divorce is a balanced and practical step, especially when demands are changing. A settlement recorded through court mediation gives legal clarity and protects both sides. For mutual consent divorce, completion of one year of separation is mandatory, and it can be planned without risk. Each step needs to be taken carefully to avoid future disputes. Mutual consent divorce requires 1 year separation. When a mutual consent divorce petition is filed, all agreed terms between the parties are recorded in the petition itself, hence no separate settlement agreement is required.
