Planning to divorce. What are my rights? What precautions to take?

My husband and i cannot stay together. There is mental harassment and physical abuse as well. I planning to divorce him. What are my rights? What evidences should i gather against him? He threatened to throw me out and wont give me any money. Will I get any financial help?

There are enough remedies available under the law to protect your rights and for maintenance. You can claim compensation and monetary reliefs from him.

Madam,
You can file petition for divorce on ground of cruelty n also maintenance. The reason for the same can be discuss with Advocate in personal meeting. For cruelty all misbehavior can be agitated in petition which can be proved at relevant time. For financial help u can ask court case charges, Adv Fees, traveling charges, kid charges of school medicine etc.

Definitely you can avail all the necessary relifs. First you should issue legal notice stating all your complaints,facts and your demands. If you are physically and mentally tortured then you must lodge an FIR. You can also file complaint under domestic violence act and seek the relifs you are in need of. Simultaneously you can file divorce petition also. By taking all these steps you may get all the necessary relifs.
