Physical & emotional touture by my wife

13-May-2023 (In Divorce Law)
Sir/MadamnnI got married on 27th November of 2020 it is arranged marriage. Soon after marriage she conceived and she was the only who insisted me to keep the baby as she loves baby although i gave her option of abortion.pregnancy was confirmed on 14th january 2021. She delivered on 27th august of 2021.wife started creating issues soon after our marriage on silly reasons she started using abusive words & physical torture after 3rd month of our marriage. At that time I thought all this is happening because of mood swing due to pregnancy. But after the delivery she became more violent, quarrels become daily with physical torture on me even she raised hand on my mother too, called my mom prostitute several times that too in front of her but I kept quite cause I took a jewelry from her after marriage due to my poor financial condition that time which I returned her recently.I want to divorce her even she doesn't take care of the baby, never breastfeed her. Can i keep the baby.

in case of separation court will not permit you to keep the baby with you most likely. If you want to divorce your wife first of all you lodge a complain with detail information of physical and mental torture through your father or mother as you said your wife raised hand and used offensive languages againest them. thereafter you can file a suit for divorce before appropreate court of law.

keeping the baby until 5 years of age of the child is difficult but not impossible. the court would go by the best interest of the child and if the court is convinced through evidence that child will be in a better state with you then the court might get inclined to allow you to keep the child.
