23-Nov-2024 (In Divorce Law)
Hi, My brother is in abusive marriage from last 11 years. She is forcing to stay separated from parents. She is continuously abusing my parents and brother. In front of her family she call my brother impotent. Now his wife and her members crossed all limits ,, they came to our house with 30 goons ( all drunk) and police to harm parents and brother. Though there were no FIR registered against my parents and brother still police forced them to make sign on settlement letter written on page.

on the above mentioned query your brother or your parents have to be file online complaint on IGRS PORTAL. and if you have proof of this incident then your brother or his parents jointly or separately file a case for domestic violence against her and in-laws of your brother. and your brother can file divorce on the ground that her wife abuse him and forcing for reside separate from parents . this ground is sufficient for divorce.

This is a clear case of harassment and misuse of legal processes. File a complaint with higher police authorities and the Human Rights Commission regarding police misconduct. Simultaneously, seek legal remedies under IPC for defamation, trespass, and intimidation. File for judicial protection for your parents and brother under Section 482 CrPC. Challenge the settlement letter in court as it was signed under coercion. To know more about your rights you can contact me.
