NRI sister accused in 498a, FIR filed online and chargesheet uploaded

03-Feb-2026 (In Divorce Law)
Sister has never met/talked to wife, not traveled to India in 15+ years yet police has included her name in FIR and filed chargesheet. Sister will soon apply for citizenship in foreign country which will require background check - which will include indian criminal database. Since FIR is online, what should be done to delete name? Quashing is not an option since it requires notary, takes time and is unfair to ask sister to attach false case quashing order in citzship app.

Since your sister has been wrongly named in the FIR despite having no connection or presence in India for over 15 years, the proper legal remedy is to seek removal of her name through a representation to the concerned Investigating Officer, supported by proof of her foreign residence. A quashing petition before the High Court can also be filed later for name deletion from the chargesheet, though physical presence or notarization may be exempted via power of attorney. This ensures her name is cleared from the online FIR and criminal records before any foreign background check.

You can can an application for discharge of accused in the court where chargesheet is filed and the court will discharged the accused if she proved her defence. I need to know other things like FIR, Chargesheet details and Notice from IO or warrant from courts to analyze it better. Contact for more advice. Regards Amit Antil

Hi there, at first to make it clear the only option to get her name out of the FIR is to either file an application of discharge and once discharge is granted file a quash in HC or directly file quash in HC. In any case you'll have to ultimately file a quash petition as the high court has exclusive powers to get her name out of the frivolous FIR. It's advisable to contact me and provide more details to devise a proper strategy for your issue.

Sir quashing is the appropriate remedy. If she resides at foreign land then she can get it notarized before the consulate of Indian Embassy of that place or another step is to move to the competent Magistrate by filing discharge application. For precise advice detailed analysis of your case is required.

Since chargesheet has been filed, the only remedy available to you right now is to quash the FIR and to do so a quashing petition has to be filed before the High Court. However, you have a valid ground and because of which you can easily get the relief.
