NRI husband torture- Wife has PTSD and associated ailments

Husband abandoned after torturing wife for several years leading to wife’s mental health decline. Is the wife entitled to lifelong medical expense maintenance or not? If she marries again will it be given , not total maintenance just medical expenses?

If the behaviour of your partner is intolerable towards you can anytime send a complaint regarding your grievances in writing to the police station according to your jurisdiction. And if you wish to go legal and if there's no scope of living together then rather stretching the relationship you should file for contested divorce under the ground of cruelty. I would suggest you to go with mutual divorce because it's cost effective and ends up in a maximum of six months.

The state puts liability on the husband to maintain his wife. If the mental health of the wife is affected by the husband, then she can claim compensation for that in addition to the monthly maintenance. Hope this helped you.

It is settled law that after divorce the wife is eligible for maintenance but not after she remarries. The best possible solution is to take the matter to Mediation and settle for a lumpsum alimony including the medical expenses and take divorce. For assistance, you may consult me.

After remarriage she won’t be eligible for maintenance but she can still file domestic violence case n look forward for the compensation ! U need to hire expert advocate in this matter! Plz be in touch Thanks
