Not including matrimonial issues in child custody petition.

18-Mar-2026 (In Divorce Law)
As of now no legal cases are present. Husband now wants to file for child custody petition (4 year girl child - i know I will not get custody, but need decent visitation). Present scenario: Separated for 9 months. But husband is getting frequent access (including overnight) for the first 7 months. Is there any disadvantage to not including matrimonial disputes but concentrating purely on why I am a positive influence for the child?

You can safely focus your case on the welfare of the child, which is the paramount consideration in custody matters. Courts are generally not interested in marital disputes unless they directly affect the child’s well-being. In fact, avoiding unnecessary allegations about matrimonial issues can work in your favour, as it shows maturity and a child-centric approach. Emphasize: Your consistent involvement in the child’s daily routine Emotional bonding and stability you provide Child’s comfort, schooling, health, and environment Your willingness to facilitate a healthy relationship with the father Since the father has already been enjoying frequent and even overnight access, the court may view this as a stable co-parenting pattern, which supports granting structured visitation rather than restricting it. However, if there are serious issues (violence, neglect, substance abuse, etc.) that impact the child, those must be brought on record. Otherwise, keep the focus positive. So, there is no disadvantage in not raising matrimonial disputes—unless they are directly relevant to the child’s welfare. A balanced approach seeking reasonable visitation while highlighting your role as a primary caregiver is the right strategy.
