not biological father-Name removal from wife's child birth certificate

Good day lawyers... I filed divorce on adultery ground against wife. Court allowed DNA petition but wife not attended for DNA test. Hon'ble court drawn adverse inference and gave me divorce decree on ADULTERY ground. But i would like to remove my name from her child's birth certificate. Please lawyers, give me any idea how to proceed and what kind of case i have to file for removing my name as i am not biological father of her child, and whom i have add as respondents in that case.

No you will not able to remove father name from birth certificate The exception is if you obtain a petition from court to remove a father's name on a child birth certificate. The reason for the court order is that the legal system wants to make sure that there are grounds for the removal.

Hi You will need to file a suit in the Civil courts for removing your name from the child's birth record. You should add the mother and the child as respondents in the said suit. The mother should also be arrayed as the natural guardian for and on behalf of the minor child in the said suit. Hope this information is useful.
