No summon received and date for exparte interim order for DV
04-Aug-2023 (In Divorce Law)
A false DV act complaint was lodged by my wife on Feb, 2017. No summons were served to me and suddenly I came to know that interim hearing was done on a recent date and date is fixed for exparte interim order at the end of August, 2017. The entire matter was not even known to me and how can court decide to order an interim amount without hearing my part. Please advise me how to deal with this situation.
You should search the court record and appear on that fixed date of ex-parte hearing by filing a petition of ex-parte vacating.
After considering your application court may vacate the ex-parte hearing and proceed with original form of the case then you can give your answer and evidence.

you must appoint a lawyer for yourself who needs to fight out your case diligently so that you can get better relief, in such cases you may be misguided, detailed discussion is necessary to understand the technicalities.
