need mutual divorce (wife pregnant)

I am 35 unemployed (Hindu) since last 5 years and wife is working and expecting a baby in next few months. Because of marital discord and mental differences, we want to file mutual divorce. Can you suggest is it possible to do now, or shall be done after baby delivery. Also, what is to be done if i want the custody of child after the period of 2-3 years (motherhood period).

Dear queriest, as per your query you both have decided for mutual consent divorce. therefore it is suggested that mutual divorce can be opted anytime since you both have decided to go for it. there is some legal procedures to be followed it can be discussed on call, secondly custody of child is up to you both to decide if you both are going for mutual divorce. for more information in detail kindly contact me.

You can certainly file for divorce right now. The only issue is the custody of the child which needs to be discussed and decided mutually before or during the pendency of the divorce petition. accordingly the court will pass a decree with specific custodial rights
