Need Legal Help for Forced Marriage and Divorce

21-Jul-2025 (In Divorce Law)
I’m a 29-year-old male, forced into marriage 1.5 years ago by my family through emotional and physical threats. I had clearly said no. There is no bonding, and I had informed the girl it was a forced marriage, but she still agreed. Now she wants to continue; I don’t. My family pressures and threatens me to stay, and I feel mentally disturbed and trapped. I want to file for divorce, but I’m the only one willing. I’m also afraid of family backlash. Please advise how to: Start the divorce process,

Hello, If your spouse is willing, you can proceed with a mutual consent divorce, which typically takes around one year to be finalized. However, if there is no agreement, you may opt for a contested divorce, which follows a different legal route and may take longer. To provide you with proper guidance, I will need complete details about your marriage, the issues involved, and any ongoing proceedings. Feel free to share the information so l can assist you better.

You can file for divorce under Section 13(1)(ia) of the Hindu Marriage Act on grounds of mental cruelty, citing being forced into marriage and continued psychological distress. Visit a family court with help from a lawyer, and file a divorce petition unilaterally (contested divorce). Collect proof of forced marriage, emotional trauma, and lack of cohabitation. If family threats continue, consider filing a police complaint or seeking protection. You can also live separately during the case. Court will issue summons to your spouse. If she contests, the case may take longer. If she agrees later, it can be converted to mutual consent under Section 13B. Prioritize your mental well-being and seek counseling or legal aid services if needed.
