Need advice on what need to be done to get divorce

18-Oct-2023 (In Divorce Law)
I am married since 20-Apr-2017. it been almost 6 months and there was no proper dialog established between me and my wife. I tried multiple times to establish a dialog but most of the times I received sarcastic or rude reply hence I did not communicate further & this continued till I tell her my decision to get seperated.she suddenly started saying that she was worried how should she talk and what if any word goes wrong etc as she was seeing me in tension since my mother was fighting with cancer. Now she is not ready to get separate and says she want 1 chance but iam really irritated with her arrogant & short tempered nature & want to get separate. We are yet to get our marriage legally registered. Can you help me understand 1. Do I need to pay her alimony and maintenance if we separate? She is working. 2. What if she and her relatives take vindictive action like file a domestic violence case against me?

In your case its only six months that you are married its some times difficult to get adjusted with the nature of other person. You can give a chance to this thaught . If you still want to get seperated then you can file divorce suit on mutual consent. Since she is working alimony cannot be considered as you do not have any issue from her. If you need any further assistance please contact me .

I would suggest you to go for councelling first.Even if you have made up your mind to get seperated court will also direct you for councelling as it's not even a year and as you mentioned that your wife was also considerate about your mother's ill health as your mom was fighting back from.cancer.I still suggest councelling and marraige mediator for fruitful/positive peace of mind

If you want to get separate you have to pay alimony since you are willing to get separated. Secondly even your marriage is not registered you still have to get separated legally only. Thirdly there are chances of wife and her relatives taking vindictive actions if you are not taking any steps which will be not convenient to the wife's family
