My wife get maintenance now, she stopped working.

My wife filed sec9, I filed sec13 1 ia. Court counseling failed. No kids. She was working women before separation(feb2022) earning upto lakh per month. I have private job. Now she is not working from last 2years. still she get maintenance if she ask court?

Hello Hope you are doing great and in good health it will depend on your defence. if you can establish that she is an qualified lady and not working out of her will and also what if she start her career back after some time? putting this strongly and citing judgement also support by saying not working though one can support society is also a wrong doings to society, may be clubbing with your earnings with your liabilities will support your case. hope this will answer your query broadly

If there's no scope of living together then rather stretching the relationship you should file for contested divorce under the ground of cruelty. I would suggest you to go with mutual divorce because it's cost effective and ends up in a maximum of six months. For more legal assistance I am just a call away.
