Can I get divorce on basis of domestic violance but I don't have proof. My husband tried to strangle me many times. He never emotionally attached to me and our son. He asked us to leave the home many times. Also he never took responsibility at home. Every expensive I have to bare. Sometimes he gives half of the expenses. He again tried to strangle me today. I am afraid of him now.

You can seek divorce on the ground of cruelty under relevant personal law. Physical assaults, repeated threats, emotional neglect, and denial of responsibility are legally recognised as cruelty. Even if you do not have direct proof, you can rely on your testimony, medical reports (if any), police complaints, messages, or witness statements. I strongly advise you to immediately file a police complaint or Domestic Violence case under the Protection of Women from Domestic Violence Act, 2005, which can provide you protection, residence rights, and maintenance. Since your safety is at risk, you may also seek interim protection orders from the court. Do not delay taking legal steps for your and your child’s safety.

Yes you can find divorce on this grounds and it is enough for you to take divorce and leave your life separately from your husband you can also seek maintenance if you want for your kid as you are working and bearing every responsibility the court would be reluctantly to grant you any maintenance but the it can be easily granted to your son.

Report to police & register an FIR You should file an FIR at the nearest police station. Important offences to include (as relevant): Attempt to murder - IPC Section 307 (if he tried to kill you). Assault causing hurt/grievous hurt - IPC Sections 323/325. Criminal intimidation - IPC Section 506. If there are dowry/domestic cruelty issues, also mention Section 498A (if applicable).
