My husband is agreeing for divorce

21-Sep-2024 (In Divorce Law)
I was separated from my husband in year 2021 and I filled for DV case and year 2024 I filled for Divorce Petition. Twice the case has been sent for mediation and both the time it got failed. I haven't asked for any alimony, but still he is not for divorce. It's been 4 years and still not resolved. Any advise what can I do now to expedite the process.

If the behaviour of your husband is intolerable towards you can anytime send a complaint regarding your grievances in writing to the police station according to your jurisdiction. And if you wish to go legal then you can also file a petition under section 12 DV or section 125 CrPC and claim maintenance for yourself. And if there's no scope of living together then rather stretching the relationship you should file for contested divorce under the ground of cruelty. I would suggest you to go with mutual divorce because it's cost effective and ends up in a maximum of six months. For more legal assistance I am just a call away.

Kindly clarify that in what grounds you filed your divorce case and which provisions. Then I can give suggestions to you. because it's compulsory to know me that which law is applicable to you e.g. if your marriage had done according to 1. Hindu rites then Hindu marriage act, 2. Muslim marriage Act 3. Special Marriage Act. kindly clarify your query

Dear Ma’am, You file the divorce Petition before the appropriate Court and then Court will look into the facts of your case and may grant you divorce. In your case it seems contested Divorce Petition is more suitable as the ofher person is not agreeing for the mutual divorce
