Yes, you can file an application for maintenance before the competent local jurisdictional court and secure an order of maintenance for yourself as well as your child. The primary factor would be his last 3 years of financial standing for deciding the same.

You have legal protection under Section 125 CrPC and the Hindu Adoption and Maintenance Act. Even if your husband retires and tries to flee or hide, a court order for maintenance remains enforceable. If he stops paying, you can file an execution petition, and the court can issue a warrant or even attach his pension or property. Keep records of all payments and communications. Also, seek a permanent alimony settlement before his retirement, which ensures a lump sum or secured monthly amount. Consult with me to take preventive legal steps.
