Mentally tortured by Husband but have no proofs

08-Jul-2025 (In Divorce Law)
My husband mentally tortured me since the 3rd day of our marriage. He told about how he thinks about every girl, lady whether she is a child or young lady or old lady. He asked me to agree for his second marriage as he wants to have more than 1 wife. Then everyday he abuses me in front of his parents and asks me to leave his home. Living with him I came to know that he is mentally sick. He thinks that everybody tries to harm him. He didn't even trust his parents and beats his father.

You may file for divorce on grounds of mental cruelty under Section 13(1)(ia) of the Hindu Marriage Act, 1955. Constant abuse, unnatural demands, and his violent, paranoid behavior can legally justify separation. You also have the right to seek maintenance, protection, and residence under the Domestic Violence Act. If your husband is mentally torturing you, even if he's mentally ill, you can take legal action under the Domestic Violence Act for mental cruelty. You can get protection, maintenance, and even file for divorce. You can also file an FIR .
