To file for divorce, you need to hire an advocate and the following steps are generally taken: The first step in filing for divorce is to file a petition in the appropriate court. This is typically done in the court where either the husband or wife resides. Once the petition has been filed, notice must be served to the other party. The other party will have an opportunity to respond to the petition. They may agree to the divorce or contest it. If the other party contests the divorce, the court may order the couple to attend counseling before proceeding with the case. Both parties will need to attend court to present their case. This may include presenting evidence and witnesses. Once the case has been heard, the court will make a judgment on the divorce. This can take several weeks or months. After the judgment, court issues the decree of divorce, which legally dissolves the marriage. In addition to the above steps, if the couple has been married for 2 years or more, they will also need to prove that their marriage has irretrievably broken down. This can be done by providing evidence of cruelty, desertion, or any other grounds that the court may consider as valid. Hope you are clear now.
