Hi, You can file an FIR against your ex boyfriend with the help of a local advocate, which is very much important to do as he may turn this into severe violence and charges against you. Let me know if you wish to connect further.

You should immediately collect all proof of threats or harassment (calls, messages, recordings, social media posts etc.) and file a written complaint before the Superintendent of Police (SP) or District Magistrate if the local police refuse to act. You may also approach the Women Helpline 1091, National Commission for Women, or file an application under Section 156(3) CrPC before the Magistrate to direct the police to register an FIR. In addition, you can seek a protection order and restraining order under the Protection of Women from Domestic Violence Act, 2005 for your safety. Do not ignore any threats — act promptly and keep all records safe.

If you are being mentally harassed or threatened by your ex-boyfriend and the local police are not taking action, you have legal remedies under the Bharatiya Nagarik Suraksha Sanhita (BNSS), 2023. As per Section 175 BNSS, if an officer in charge refuses to register your complaint, you can directly approach the Superintendent of Police (SP) in writing or via email with details of the incident. The SP is legally bound to either investigate the matter themselves or direct an officer to do so. Additionally, such threats and mental abuse can amount to offences under Sections 352, 506, and 509 of the Indian Penal Code (now Bharatiya Nyaya Sanhita). You can also file a complaint before the Magistrate under Section 190 BNSS seeking directions for investigation or issuance of protection orders. If you fear immediate harm, you may approach the nearest Women’s Cell or Protection Officer for assistance and safety measures. Keep all evidence such as messages, call logs, or witness accounts, as they will strengthen your case.
