Marital affair not allowing to meet and change kid father name also

My wife ( without divorce ) living in relationship with a married guy and both were staying in a same flat and not allowed to meet my 10 years old kid. In school records she mentioned married guy name as my kid father name and sur name also both were state govt employees ,Is this helpful to file a Bigamy and I want my kid custody permanently is it possible..

You can file a divorce case on the ground of cruelty and adultery but not on the basis of bigamy. Bigamy will be applicable only when your wife has legally married with the married guy. Since she has not married him, she is just living in an adulterous relationship and not a married relationship. Therefore you cannot file for bigamy, but cruelty or adultery.

Yes, you can file a case of Bigamy against your Wife, if she will be held guilty under this, she has to undergo Jail Punishment for years + you can seek Divorce on the ground of Adultery + You can get the Child Custody too on proving Adultery of your Wife.
