From the facts stated, you have valid legal grounds. If material facts such as serious medical or mental health issues, previous relationship, or unwillingness to lead a normal marital life were suppressed before marriage, it amounts to fraud and cruelty under law. Non-consummation of marriage, suicidal behaviour, and refusal to cohabit are also recognised grounds for divorce. You should immediately collect and preserve medical records, messages, witness statements, and any proof showing concealment of facts and her conduct during the short period of cohabitation. These will be crucial before the court. Regarding the maintenance case, you have the right to contest it by proving that she is capable of earning, that the marriage broke down due to her conduct, and that she voluntarily left the matrimonial home. The court considers both parties’ circumstances before granting maintenance. It is advisable to pursue a strong defence in the maintenance proceedings and simultaneously initiate or continue appropriate matrimonial proceedings based on cruelty, fraud, and non-consummation. Early and proper legal action will help protect your rights and reduce future liability.
