Loan bought in wife's name by husband to repay his existing loan
31-Aug-2023 (In Divorce Law)
My husband took loan in my name (oct 2019) immediately in next month of marriage(sep 2019) (since he is already paying personal loans for the construction of house in the name of his father and because of this he is not eligible to get other loan) The loan amount is 3L and he took the loan only to re-pay his all his old loans. And he purchased bike in EMI and I am the one who is paying. He also used my previous savings of 45000 money to pay his other loans as well. In this case what happens after divorce. For all the loan I have not enjoyed anything merely is to pay his old loans. Will this loan amount will be repaid to me? It is also noted that we have not registered our marriage (which should be under special marriage act) because of this lock down. The other thing also to be noted is the house is under his father's name. Please advise will I get my loan amount back.
Dear client
Greetings to you
Hope ur safe
if the loan s in your name means you have to repay it fully.
But if ur processing for mutual divorce you can't claim Maintenance from your husband.
Else my suggestion is send legal notice on priorities and claim maintenance.
Any further legal help contact me.

In this case, under the Special Marriage Act, 1954, only the wife is entitled to claim permanent alimony and maintenance. When a couple gets divorced by mutual consent, the decision on whether any alimony/maintenance is to be paid by either party is a matter of agreement between them. In such cases, alimony/maintenance could be paid by either the husband to the wife or by the wife to the husband subject to the mutual understanding between the couple. The court passes the decree of divorce on terms agreed between the couple. The decree binds the couple and is capable of being enforced by the court. I have a vast practice in that area you can seek my assistance in your matter.
