Living separately from my husband can I ask for maintenance

I am living separately from my husband for 4 months..He is not ready to live with me and neither he is asking for divorce..can I claim for maintenance as at present I am not earning....He is earning around70 to 80,000 per month...I was also earning 24000 per month...but I resigned and shifted myself to my parents home...it's not the matter of money as I am searching for job...but I am not getting good opportunity and my father is only earning person in family...therefore can I ask for maintenance???

Under the given circumstances, you have right to seek maintenance from your husband under 125 CrPC as well as under Domestic Violence act, though maintenance from husband may be sought under civil law (HAMA & HMA). You can definitely claim maintenance by filing a case under section 125 of cr p c, you can also file case of domestic violence against your husband.
