Litigation Fee For Wife On Divorce Case

I was asked to pay Rs.15000/- litigation fee to my wife on next hearing. Is it mandatory ? Or is there any way to avoid this? Please suggest.

The general rule is that the successful party is entitled to cost unless he/she is guilty of misconduct, negligence or omission or unless there is some other good cause for not allowing costs. It’s just a matter of arguments in the court. For more legal assistance I am just a call away.

Litigation fee is decided at the stage of final decree. Before that if the court orders any payment qua your wife, the same can be dependent upon the prima facie view of her incapability to join the litigation on the first date of hearing. If paying of litigation fee has been ordered by the judge and has been recorded in the order, it is absolutely mandatory to make the payment on next date of hearing to avoid further penalty.
However your advocate can move an application seeking exemption from paying litigation fee to wife on certain grounds.
