LEGAL NOTICE FOR DIVORCE AFTER FALSE 498a

hello , My wife file false 498A case against me and 6 other members at place near ajmer rajasthan out of her judiciary showing herself as living in temporary resident. she file FIR under IPC 498A ,406, 323. can i send legal notice for divorce before court hearing ? before chargesheet preparation.? or should i have to wait till quashing in HC.?even after false 498 FIR she continuously torture me by calling from diff num using fake social media ids she reaches to my relative and friend circle.

You have all the rights of sending her legal notice for any reason you feel appropriate. there's no hard rule of quashing in HC. generally, HC would be very cautious in cases related to domestic harrasment cases. Quashing doesn't always work in such cases. Though, it's not my legal opinion, but I am of the belief that, you need to take quick action. it's not only you. your family is also involved. you can't manage the police from other state.
