Lawyer not responding clearly initiating the case


10-Mar-2026 (In Divorce Law)
My lawyer agreed to litigate divorce case by first sending legal notice to spouse for amicable settlement.i paid half advance fees to lawyer. It has been 2 weeks but lawyer is postponing & not clearly stating wen he'll draft notice & not responding from his side. No agreement was signed with lawyer for his service. Please suggest what todo now? No work has been initiated yet. What if he refuses & doesn't give fee back. I already am financially low.

You may send a written communication to the lawyer seeking a clear timeline for drafting the notice. If no work has been initiated, you may request a refund of the advance fees. In case of refusal or continued non-response, you may approach the State Bar Council or engage another lawyer.

Send a final written request Send a message giving 3–7 days time asking: Status of filing Copy of documents Refund if work has not been done Keep proof of payment and chats. 4. Change the lawyer You have full right to appoint another advocate and continue the case. Your new lawyer can file a Vakalatnama and proceed. 5. Complaint against advocate If the lawyer took fees but did not work on the case, you can complain to the Bar Council of India under the Advocates Act, 1961 for professional misconduct.

Send a written notice/email seeking status or refund. If no response, change lawyer. You can file complaint before Bar Council for deficiency of service and seek recovery of fees. Keep payment proof as per the concerned provisions of law.
