Lawyer is delaying in filing DV and maintenance case

I have filed divorce case 1year back but still DV and Maintenance is not filed by my lawyer he is saying only after your IT returns get filed of 10 years then only we will file DV my Question is there connection between DV and maintenance case ?is it necessary to file Maintenance before filling DV.
