You can always file a petition for the salary garnishment, i.e. the court can order to deduct maintenance directly from their salary of the JD. The bank accounts and movable/immovable properties can also be attached and sold to clear the maintenence dues. For more legal assistance I am just a call away.

You may respond as follows: As the Decree Holder, you should strongly oppose the bail application by highlighting the JD's wilful and continuous disobedience of the maintenance order, accumulation of arrears of nearly ₹4 lakhs, and deliberate non-compliance despite coercive steps. Seek bail only on strict conditions, such as deposit of the entire arrears or at least a substantial portion (50–75%), along with an undertaking to clear the balance within a fixed timeline and continue paying future maintenance regularly. Request the court to direct disclosure of the JD's assets, bank accounts and income, and seek attachment of salary, bank accounts or movable/immovable properties under the execution provisions of the CPC, wherever applicable. If the JD defaults after release, pray for cancellation of bail and issuance of fresh coercive process.

The bail application can be opposed by you stating his intention of non-payment of maintenance amount having arrears of 3.80 lacs and request to lay down certain conditions before grant of bail as JD should deposit a significant portion of arrears, request for a signed undertaking that JD will make the payment within a stipulated time. The court can also attach JD assets for auction to recover the maintenance amount, if deemed necessary.

If the judgment-debtor (JD) has been committed to civil prison for non-payment of maintenance arrears, the detention does not extinguish the liability to pay the arrears. The decree-holder can continue to pursue execution for recovery of the outstanding amount through other modes permissible under the applicable law, such as attachment of salary, bank accounts, movable or immovable property, if such assets are available. The fact that the defence has been struck off in the original proceedings also does not by itself affect the execution of the maintenance decree. As regards the bail application, there is no automatic entitlement to bail merely because the JD has been taken into custody. The court may consider factors such as the nature of the custody, the JD's conduct, willingness to clear the arrears, financial capacity, and whether continued detention would serve any useful purpose. In many cases, courts grant release subject to conditions, including payment of the entire arrears or a substantial portion thereof, furnishing security, and an undertaking to regularly pay future maintenance. The exact conditions, however, will depend upon the facts of the case and the statutory provisions under which the detention has been ordered.

Hi there, in this scenario you can request the executing court to keep quantum of his bail bond at the higher side (upto 50% of the pending amount). Further, the ground that can be taken by him can be either he doesn't have earning capacity or has been insolvent for which he will need to provide strict proof. It's advisable to contact me and provide details of the matter to assist you better at defending the bail.
