Is talaq by Qazi without spouses signature and witness valid or not

does talak done by kazi without husband & wife's signature and without witness valid or not. Since Madras High Court judgement under sec. 4 of kazi act it is not valid can this be used in maharashtra.
It is valid as talaq in Muslim law need not be in form of written document it can be given orally before a witness if there after the wife sit for iddat that is presume that she has accepted it and is estoppel from denying the same .
