Is a fraudulent divorce document enforce divorce proceedings

Hello sir/mam, I and my husband got married on one month back in arya samaj temple without the parents consent. We both are hindu. He is 25 years old and i am 24. But when my husband told his mother she got sick and emotionally blackmailed him to get a divorce. My father in law is supporting us but just for an eye wash he got a deed of divorce on 100 rs stamp paper and showed it to his mother. Is this deed of divorce legal divorce. And can my husband take this to court and ask for divorce. And what is the validity time of this papers? I mean can he use this papers after 1 year also for divorce if he wants to. I know he doesn't want that. But just for safe side i am asking this.

Hi,

A deed of divorce is not valid. In fact there is no such document as divorce deed. A divorce can be only granted by the family court and that to by the passing a proper order a divorce cannot be taken on 100 rupees stamp paper but to be on safer side I'll ask you to show the document to your lawyer

Any authenticated legal document which is registered legally can be used any point of time in life to use or misuse in court as well.Please think prudently and keep that original legal document with you rather than relying on anybody else.Kindly use your basic intuitive powers and your own belief to have complete trust on anybody blindly.

The deed has no value and will not stand be valid in Court. But do remember not to sign such deeds in future as it can be construed against you for other purpose if the deed is used wrongly. Remember never to sign deeds etc which you don't agree to or havent read the contents.

Don't worry at all. This stamp paper have zero value. Divorce cannot be taken on stamp paper in Hindu Law. No any use of stamp paper. We can filed criminal complaint against in laws as well as we can filed petition under Domestic Violence Act.
