Interim Maintenance paid wife not filing evidence affidavit

Case of DV 12 registered in 2019 . Income affidavits filed in 2021 . Regular maintenance is paid to wife with all the arrears cleared till date and on time. Wife deliberately not attending the dates and not filing evidence affidavit to finalize the maintenance. She is happy with Interim Maintenance order and does not want to finalize the amount. We have lots of proofs what she have hidden in her income affidavit and that s why running away from court dates. Can I stop paying interim maintenance ? or we can already bring in notice of the court for the misuse of law . Our lawyer is suggesting to wait for wife Evidence affidavit and than disclose the facts of her false income affidavit.

if your wife file a false income affidavit befor court then court should be able to file a case himself against your wife for false affidavit..you also pray before court for early hearing..if your wife running away from court then you pray for next step without affidavit.

the right to speedy adjudication and expeditious disposal is a right recognized by the Hon'ble Supreme Court of India time and again as an integral part of Article 21 of the Constitution of India. if opposite party does not file affidavit move and application to close the opportunity before maintenance Court or move to high court for expeditiously disposal of maintenance application with a mandated time frame
