Incorrect observation recorded in interim order, how can I correct it?

09-Mar-2026 (In Divorce Law)
I received an interim order in a child visitation case. The order records that I said I cannot leave my career to stay in India and chose career over my child. This is opposite to what I actually said in court. I had stated that I am in discussions with my employer to relocate to India. Note: I spoke to my employer 3 months before the hearing - What is the proper legal way to correct such an incorrect observation in the order? - Can a memo or clarification be filed?

If the interim order contains an incorrect recording of your statement, you are legally entitled to seek correction. The proper course is to file an application for clarification/modification of the order before the same court, pointing out that the observation does not reflect what was actually submitted during the hearing. Courts have inherent powers to correct factual or clerical errors in their orders, particularly where a party’s statement has been inaccurately recorded and may affect the merits of the case. Along with the application, you may place supporting material, such as correspondence with your employer or other documents showing that you were actively exploring relocation to India. A simple memo alone may not be sufficient if the observation forms part of the reasoning in the order. Therefore, the safer legal approach is to file a formal application seeking clarification or modification of the interim order, requesting the court to record the correct position and remove the incorrect observation. This will ensure that the record accurately reflects your submissions in future proceedings.
