I’m male,31y,hindu Filed case divorce petition under HMA 13, 1, Ia, Ib

My wife have shifted to Australia 1.6Yrs ago. As of now I don’t know the current address of her. There is an issue with serving divorce notice because of this. I have served notice 3 times through court to her Aadhar card address but notice has reached her. “Notice of Respondent not served. The petitioner shall serve Notice to the respondent by 24.01.2025 failing which OP stands dismissed for default. Call on 24.01.2025.” From recent hear. What can be done in this situation.

Sir, Since your wife is in Australia and summons from family court are not served on the aadhar address then in that case you can ask the Hon'ble court for substituted service of summons. Under that you can seek permission from the Hon'ble court to publish the divorce notice in any national and local newspapers by providing sufficient time to her for her appearance. Thereafter she can be a proceeded exparte. For further query please contact us.

U can serve her notice through WhatsApp or email if possible other than u can make request to the court to publish the summon in newspaper there after they proceed with the ex parte process and the suit continue

Hi! You could have requested for service of notice through all modes. I am afraid, without address, nothing can be done. Additionally, I would suggest you get summons prepared and have your advocate send the same to your wife via email and WhatsApp. Submit the proof in court. The court might accept it as proof.

You can take the following steps: 1. Substituted Service: File an application under Order V Rule 20 CPC to serve notice via newspaper publication or digital means like email or social media. 2. Consular Help: Request service through the Indian Embassy or Consulate in Australia. 3. Proof of Efforts: Submit evidence of all attempts made to serve the notice. 4.
