If i take job where salary is more then husband will I get the alimony

Currently i have taken up contract base job, i have filed a petition in court for divorce it is still under reading. I would like to know if i take up full time job and earn more than my husband will I not be liable to get child maintenance and alimony? My husband earns in cash so no proof to prove his income, he doesnt even pay IT returns. Also my jewellery, the 2 wheeler that is in my name is all with him and not ready to return. Plz guide and help.

Hello,
So far maintenance is concern you will not get it if he proves in court of law that your course of income is higher than him n as far as kids r concern you have to show he is liable to maintenance of kids on basis of his school etc. N as far as your stuff lying with him you can seek appropriate orders from court.

Dear client if husband proved in court that U r working then u will not get maintenance for u. But he is liable for the maintenance of child. U can file application under sec 125 of criminal procedure code to ask maintenance. For any legal help call me

You can still get maintenance / alimony for your child. If you start earning more than your husband it is you who will not get maintenance / alimony from your husband. However for a child's welfare and maintenance both father and mother are responsible even if they are divorced. For getting articles you can claim them in divorce proceedings or by filing a complaint of Domestic Violence under Domestic Violence Act or by filing 498A UNDER Indian Penal Code.
