Dear sir, Me and my spouse had filed a petition u/s 13B of Hindu marriage act, in which permanent alimony has been decided at the time of filing of case( divorce by mutual consent), alimony amount has been decided to be paid in 2 parts, 1st part has been paid already at the time of filing of petition and 2nd part is to be paid at the time of second motion(as written in agreement) My lawyer told me that remaining alimony to be received before filling my statement. But if 2nd petitioner does not give the remaining alimony, then what should I do, Can I refuse to file statement. He told me to give the amount at the time of judgement.

YEs, as per the agreement if he does not pay you the remaining amount of the alimony, you can refuse to give your statement or even tell the court that as per the agreement the payment is due towards him, the court shall take necessary step and give time to you both
