In general: No, your husband cannot lawfully use force to take the child away from you merely because he is the father. If he does so without your consent and without a court order, it may give rise to legal consequences, and you can seek immediate police assistance or approach the appropriate court. If no custody order exists, both parents are natural guardians (though the mother is often preferred for custody of a very young child). This means neither parent has an automatic right to unilaterally remove the child by force. If your husband believes the child should live with him, the proper legal remedy is to file a custody or guardianship petition before the competent family court under the Guardians and Wards Act, 1890 (and, for Hindus, the Hindu Minority and Guardianship Act, 1956 may also apply). The court will decide based on the welfare of the child, which is the paramount consideration.

Merely because there is no divorce does not give your husband the legal right to forcibly take away the child. The welfare and best interest of the child is the paramount consideration in every custody dispute. If the child is living with you and is well cared for, your husband cannot lawfully remove the child by force. If he attempts to do so or threatens you, you may immediately seek appropriate relief from the Family Court, including an interim custody order and protection orders, depending on the facts. Please mention the child's age, religion, and whether you and your husband are currently living separately, so that proper legal advice can be given.
