I want to check where can i file divorce and what documentation is req

22-Sep-2025 (In Divorce Law)
I got married in 2020, the ceremony and marriage registration happened in Vadodra, Gujarat. Both of us were based out of Bengaluru. However, after approximately 1 year of marriage we separated due to certain irreconcilable issues. I have now been residing in Delhi for last 3 years. We are now ready for a mutual divorce. I want to check if I can file for divorce in Delhi? & what documentation would be required.

Since you have been residing in Delhi for the last 3 years, you are entitled to file your mutual divorce petition before the Family Court in Delhi. Identity & Address Proofs of both parties (Aadhar, Passport, Voter ID, etc.). Marriage Certificate (from Vadodara). Joint Photograph(s) of Marriage Ceremony (helpful, though not mandatory in all courts). Proof of Separation (not mandatory, but rental agreements, communication, or affidavits may help). Mutual Consent Divorce Petition (to be drafted by an advocate and signed by both parties). Terms of Settlement (alimony/maintenance, child custody (if applicable), division of property/assets). Passport-size photographs of both spouses.

Yes sir as a residential place you can file divorce in delhi. The process involves filing a joint petition in the family court, giving statements (first motion), waiting six months (cooling-off, which can sometimes be waived), and then appearing again for the second motion. If both still consent, the court grants the divorce decree, usually taking 6–18 months, or less if waiver is allowed.

You can file mutual consent divorce in Delhi since you have been residing there for 3 years. Petition will be under Section 13B HMA. Documents needed: marriage certificate, ID/address proofs, photographs, and settlement terms (if any). Court procedure involves two motions, with 6-month cooling period (waivable in some cases).
